TERMS AND CONDITIONS

The following terms and conditions are those which Roberts Don Mac P/L (“Roberts Don Mac”) and the Customer have agreed apply to the supply of goods, services and credit with Roberts Don Mac.

 

(a) All goods, services and credit supplied to an Account Customer during any calendar month must be paid for or repaid in full by the Customer on or before the expiration of the next calendar month, late payments will attract a late fee of 10% (ten percent) accrued monthly and compounded.COD Customers to be paid in full at time of purchase.

 

(b) Warranty claims for faulty goods are determined by the product supplier’s warranty claim terms which can be found on the supplier’s website.

 

(c) The Account Customer shall pay all Financial Institutions Duty, stamp duty and other government charges relating to the establishment or operation of the Customer’s account and such charges may be debited to their account as and when they occur.  The Customer shall also pay to Roberts Don Mac on demand all commissions, costs and expenses (and in the case of legal costs on a full indemnity basis) incurred by Roberts Don Mac in relation to the recovery or attempted recovery of any overdue monies owing by the Account Customer or the exercise, enforcement, attempted exercise or attempted enforcement of any of these Terms and Conditions.

 

(d) Roberts Don Mac reserves the right at all times to suspend or discontinue the supply of goods, services and/or credit to the Customer without being obliged to give any reason for its action.

 

(e) If the Account Customer comprises two or more persons then those persons are jointly and severally liable to pay all monies payable in relation to the account.

 

(f) In the event that Roberts Don Mac receives or holds any monies otherwise payable to the Account Customer it may at its discretion apply any or all of it to the outstanding Principal and accrued interest for the account.

 

(g) Until the goods supplied by Roberts Don Mac are paid for in full the property in such goods shall remain the property of Roberts Don Mac and the Customer hereby authorises Roberts Don Mac or its duly authorised agent at any time and without prior notice to enter upon and into any premises where such goods may be stored and to remove some or all of such goods and proceed to sell such goods so moved for such price as Roberts Don Mac sees fit.

 

(h) The Customer hereby agrees and authorises, in accordance with the provisions of the Privacy Act 1988 or any legislation or in substitution of it, the disclosure of any information by any credit reporting agency to Roberts Don Mac or its agents and the use by Roberts Don Mac of the information in relation to any dealings with Roberts Don Mac howsoever arising.  The Customer also gives permission to Roberts Don Mac to disclose all relevant credit information to all relevant credit providers and acknowledges that certain information in the processing of the account application is to be given to a credit reporting agency.

 

(i) The risk in any goods supplied to the Customer shall pass to the Customer immediately upon the dispatch of those goods to the Customer.

 

(j) The customer hereby agrees and authorises the various uses and disclosures set out in the Privacy Statement in this document in relation to their personal information collected by Roberts Don Mac from this document.
